Brief Biographical Information

In 1989, Jimmy began the firm of Simien & Simien, LLC with emphasis on Admiralty and Maritime, Class Actions, Constitutional Law, Criminal Defense, Mass Tort, Personal Injury, Wrongful Death and other major litigation. Other areas the firm has extensive experience with include Insurance Bad Faith, Insurance Claims, Constitutional Law, Bankruptcy, Commercial Law and limited Criminal Defense matters.  During his tenure with the firm, Jimmy was chosen by his peers to be section chief of the ATLA Litigation Committee involving CCA (Chromated Cooper Arsenate) Wood.  The focus of that Committee was on litigation pertaining to CCA pressure treated wood, which leaked toxic substances on consumer/end users and onto their property.  This appointment stemmed from Jimmy's pioneering work on some national litigation and other cases from around the country involving CCA wood.  Jimmy Simien has handled complex cases involving serious and debilitating personal injuries to children, including brain injuries and near drownings. He is a contributing author to Children and Injuries, Copyrighted 2001 and published by Lawyer and Judges Publishing Inc. Jimmy has also written articles on environmental and toxic tort issues.

Education

Jimmy Simien graduated from McNeese State University with a B.A. in Pre-Law in December of 1978. He then attended law school at Louisiana State University, Paul M. Hebert Law Center and earned his Juris Doctorate Degree in May of 1982.

Legal Career

Following Jimmy's graduation from law school, he received a one-year appointment as a Civil District Court law clerk in the 19th Judicial District Court in Baton Rouge, La. He was then offered the position as an Assistant Attorney General by the Louisiana Attorney General and the Louisiana Department of Justice.

Jimmy worked in both the civil and criminal divisions, while working for the Department of Justice.  He started with the Department as a white collar crime prosecutor in the Medicare/Medicaid Fraud Control Unit and later as a civil lawyer in the Department of Justice's Civil Division.  During his tenure at the Department of Justice, he was involved in complex litigation that required the organization and collection for use at trial of massive document productions.

After working for the Department of Justice, Jimmy was offered the position of Assistant District Attorney for East Baton Rouge Parish. Jimmy was responsible for multiple civil matters and the formulation of effective procedures for bond forfeiture and collections.  In addition to his other responsibilities, Jimmy acted as the liaison between the East Baton Rouge Parish District Attorney's Office and the State Office of Probation and Parole.  His duties as prosecutor also included the trial and trial preparation of various felony and misdemeanor cases.

In addition to his required duties and role as liaison with the State Office of Parole and Probations, Jimmy successfully drafted and guided the passage of amendments to Louisiana's legal provisions relating to assertion of defenses to collection of bond forfeitures and notices of forfeitures through the legislative process.

Following a successful tenure as an Assistant District Attorney, in 1987 Jimmy joined a plaintiff's personal injury litigation firm.  While there, he successfully managed, on average, more than 200 injury and litigation files.

In 1989, Jimmy began the firm of Simien & Simien, LLC with emphasis on Admiralty and Maritime, Class Actions, Constitutional Law, Criminal Defense, Mass Tort, Personal Injury, Wrongful Death and other major litigation.  Other areas the firm has extensive experience with include Insurance Bad Faith, Insurance Claims, Constitutional Law, Bankruptcy, Commercial Law and limited Criminal Defense matters.

Members of the Simien & Simien law firm have served as members of steering committees on numerous class action litigation cases.  Class action litigation cases include medical devices, consumer products, telecommunications, oil and gas, fraud and other consumer-oriented litigation.  The firm also is involved in large-scale toxic tort and environmental cases involving injury and diminution of property value.

Simien & Simien, LLC has also been involved in cases of underground contamination, including class action litigation where citizens of a small community sued Conoco and Condea-Vista and received a record settlement of over $46,000,000.00. In addition, Jimmy Simien and other members of the firm were selected to represent the State of Louisiana in one of the five key states to initiate the "Historic Tobacco Litigation" which generated a $4,600,000,000.00 billion dollar recovery for the state.

During his tenure with the firm, Jimmy was chosen by his peers to be a section chief of the ATLA Litigation Committee involving CCA (Chromated Copper Arsenate) Wood. This product leached impregnated carcinogens, exposing them on contact to workers, consumers and end users. This work concerned issues involving national litigation and cases from around the country.

Jimmy Simien has handled complex cases involving serious and debilitating personal injuries to children, including brain injuries and near drownings.  He is a contributing author to Children and Injuries, Copyrighted 2001 and published by Lawyer and Judges Publishing Inc. Jimmy has also written articles on environmental and toxic tort issues. He has appeared in numerous jurisdictions and is admitted to practice before all federal district courts in Louisiana, the Louisiana Supreme Court and all inferior state courts.

Jimmy is also admitted to practice before the United States District Courts for the Eastern, Middle and Western Districts of Louisiana.  He is a current member of the Baton Rouge Bar Association, Louisiana Trial Lawyers Association and American Trial Lawyers Association.

Brief Biographical Information

Eulis Simien, Jr., graduated from McNeese State University with a B.A. in Political Science in December of 1977.  Eulis attended Louisiana State University's, Paul M. Hebert Law Center.  He graduated with honors in 1981 and was a member of the Order of the Coif.  Eulis received an LL.M. from Columbia University School of Law in 1987.  Eulis was a member of the faculty at the L.S.U. Law Center from 1984 through January, 1994. Eulis received tenure in the shortest possible time after joining the faculty he remains an active member of the adjunct faculty.

Upon leaving full-time status at the L.S.U Law Center, Eulis became a member of the Simien & Simien Law Firm. Eulis is admitted to practice before the United States Supreme Court, Fifth and Eleventh Circuit United States Courts of Appeals, all federal district courts in Louisiana, the Louisiana Supreme Court and all inferior state courts.

Eulis Simien maintains a general trial and appellate practice with emphasis on the areas of Personal Injury, Admiralty and Maritime, Class Actions, Complex Litigation and Criminal Defense.

Brief Biographical Information

Mark Simien graduated from McNeese State University in Lake Charles, Louisiana. He began working in the Chemical industry as an Operator/Processor.  During his tenure with the Chemical industry, Mark worked as both a relief supervisor, being placed in charge of several plant improvement projects, as well as relief supervisor for plant operations. Mark also worked as relief supervisor for the plant's laboratory and was in charge of maintaining the scheduled and special testing necessary to maintain operations and shipments of the plant.  Mark took this valuable experience with him to law school and then into practice when he joined the firm in 1994.

Education and Early Career

A Dream Fulfilled

In 1990, following an on-the-job injury, Mark fulfilled a dream he had long put aside by attending Louisiana State's Paul Hebert Law Center. Mark W. Simien was awarded a Juris Doctorate Degree from L.S.U.'s Paul M. Hebert School of Law. He was admitted to practice law in October of 1994 and is a member of the Louisiana State Bar Association. Mark is admitted to practice before the Louisiana Supreme Court and all inferior courts in the state of Louisiana.

Mark has been a member of the Simien & Simien Law Firm since his graduation from law school.  He maintains a trial and appellate practice with emphasis in the areas of Class Actions, Mass Tort, Personal Injury, wrongful death and other major litigation.  Mark, along with other members of the firm, is involved in large scale class action and mass tort litigation. Some of the Class Action cases he has been involved in include medical devices, consumer products, telecommunications, oil and gas, fraud and other consumer-oriented litigation.  Mark was specifically requested to be involved in large scale toxic tort and environmental cases involving injury and diminution of property value.  Mark was part of the team involved in the successful class action litigation for citizens of a small community which sued Conoco and Condea-Vista and received a record settlement.
